GCT Forum · Global Customs & Trade Compliance

The Weekly Manifest

Edition 41 · Week of 26 Oct 2026
Published Sun 22:00 CET · gctforum.org

A cadence-sorted monitoring board for global trade compliance professionals — what to watch in real time, what to check daily, and what can wait for the month- or year-end cycle.

Tariffs · China

Beijing confirms the truce — but the Nov 9 cliff still needs its own notice

China publicly confirmed the truce extension to 10 Jan 2027 during Xi’s 28 Sep Washington visit, resolving the uncertainty flagged last cycle. That confirmation doesn’t touch a separate deadline, now two weeks out: the 178 Section 301 exclusions (heading 9903.88.69) and the suspended Chinese-vessel service fee both lapse at 11:59 p.m. ET on 9 Nov unless USTR issues a fresh Federal Register notice extending each on its own. The 16-economy “excess capacity” Section 301 action, reportedly eyeing a 7.5% duty, remains unannounced.

Customs · US mail

CBP buys importers 90 more days on mandatory Entry Type 13

A 22 Oct final rule (Federal Register 2026-21600) pushed the compliance date for formal entry of international postal merchandise — the deadline that forces mail shipments into Entry Type 13 or formal entry — from 22 Oct to 20 Jan 2027. It’s a filing-runway extension, not a reversal: the broader proposed rule that would make ET13 permanent, add bonding, and require a licensed broker as importer of record for non-owner consignees (91 FR 64532) still has comments due 7 Dec 2026.

Export controls · Ownership

Two weeks to BIS’s 50% Affiliates Rule enforcement date

After a year-long suspension, the rule extending Entity List, Military End User, and SDN restrictions to any entity 50%-or-more owned by a listed party takes effect 10 Nov. Ownership-chain diligence — not name-only screening — becomes a hard requirement from that date; confirm screening vendors can flag aggregate ownership stakes, not just direct name matches.

Customs · EU

One week out: EU product identifiers and the €2 Union handling fee

From 1 Nov, B2C e-commerce customs declarations into the EU need a standardized or non-standardized product identifier, and the same date brings the €2 EU-wide handling fee created by the Customs Reform Regulation (2026/2108) — replacing the interim €3 flat levy that has applied since 1 Jul. Confirm platform and carrier systems can capture both before the switch.

Customs · Italy

Italy’s parcel fee is now backed by an enacted decree — with its own expiry risk

Decreto-legge 162/2026, published 17 Sep, is what actually moved Italy’s €2 handling fee to 1 Dec — an in-force decree, not the draft awaiting Cabinet sign-off that last cycle flagged. Under Italian constitutional practice, an unconverted decree-law lapses 60 days after publication, so Parliament must convert it into law by 16 Nov or the 1 Dec date itself unwinds. Conversion is the norm, not the exception, but the date belongs on the calendar.

New tariff & export-control proclamations

Rate structures are moving on multiple tracks at once: the China truce’s 9 Nov exclusions/port-fee cliff (now two weeks out), forced-labor Section 301 tariffs on 60 economies, Section 232 sectoral rates, and Section 338’s still-shifting Canada scope. Any one of them can reprice a lane overnight.

CBP detentions, seizures & WROs

UFLPA and forced-labor detentions demand an immediate admissibility response — CBP’s forced-labor enforcement has kept opening new sectors (palm oil in late Sep) even while Entity List additions pause.

IOR-number voidance notices

Since 18 Sep 2026, CBP can immediately void an importer-of-record number if Form 5106 identity data — legal name, tax ID, address, direct email, valid POA — fails verification. A voided number stops clearance same-day; confirm your data is current before a notice arrives.

Section 301/232/338 tariff lists

Rate structures keep layering: China publicly confirmed the truce extension to 10 Jan 2027 during Xi’s 28 Sep Washington visit, but the 178-heading exclusion list and the suspended vessel fee both lapse 9 Nov — now two weeks out — regardless, unless USTR separately extends them. The 16-economy “excess capacity” Section 301 action remains unannounced, Brazil’s distinct 25% Section 301 tariff continues, and Section 338’s Canada scope keeps moving. Re-check coverage, exclusions, and the Nov 9 date weekly.

Section 122 / IEEPA / forced-labor 301 — refund & challenge litigation

CBP's CAPE Phase 3 — reliquidating finally-liquidated entries for roughly 3,700 pending plaintiffs per a CIT order — went live 6 Oct. The Federal Circuit's stay of the CIT's 7 May ruling against the Section 122 surcharge (State of Oregon v. Trump) still has no merits decision. A separate consolidated challenge to the forced-labor Section 301 tariffs on 60 economies, argued at CIT on 30 Sep, is also undecided. Track all three dockets as distinct refund exposures.

USMCA Joint Review tracker

The Jul 1 Joint Review ended without renewal: USTR declined to renew in current form despite Mexico and Canada each backing a 16-year extension, so USMCA now runs under annual reviews through 2036 instead. Mexico and the US have run several bilateral rounds on autos, steel/aluminum, labor and agriculture; Canada has had no comparable formal talks. USTR's consultation for the 2027 review stays open — comments and hearing-testimony requests are due 12 Jan 2027.

UFLPA Entity List additions

DHS's 31 Jul addition of 43 companies was the largest single expansion on record; nearly three months on, nothing further has posted to the list itself — though CBP's late-Sep Indonesian palm-oil WRO shows forced-labor enforcement hasn't paused. Watch for the next Entity List batch.

CBAM certificate price & verifier guidance

The Commission's Q3 2026 CBAM certificate price published on schedule 5 Oct: €82.32/tCO2, up from €75.28 in Q2 and €75.36 at the program's 7 Apr launch. No new price update is due until the Q4 2026 figure on 4 Jan 2027 — the last quarterly reset before CBAM moves to weekly pricing in 2027. National handling-fee patchwork

Italy's €2 fee has slipped a third time, and this time it's enacted rather than proposed: Decreto-legge 162/2026 (published 17 Sep) moved the start to 1 Dec 2026, a month after the EU-wide handling fee arrives 1 Nov under the Customs Reform Regulation. The decree itself must be converted into law by 16 Nov or it lapses by operation of Italian constitutional practice — worth a calendar flag even though conversion is the norm. The Netherlands, Belgium, and Luxembourg proposals that were on hold pending “an EU-wide approach” now have one — expect those national plans to be absorbed rather than run in parallel.

EO 14411, next phase: import disclosures & Global Business Identifier

CBP's 2 Sep 2026 advance notice of proposed rulemaking (“Heightened Import Disclosures for Supply Chain Visibility,” FR 2026-17926) formalizes the next phase beyond the IOR-data rule: retained foreign export documentation, a new Global Business Identifier to replace the manufacturer ID code, and AI-driven transshipment tracing. CBP's low-value shipment rule & Entry Type 13 — compliance date now pushed

CBP's 22 Oct final rule (FR 2026-21600) gave filers 90 more days on formal-entry compliance for international postal merchandise, moving the date from 22 Oct to 20 Jan 2027. That's separate from the broader 8 Oct 2026 proposed rule (91 FR 64532), which would require pre-arrival electronic filing for $2,500-and-under shipments, make Entry Type 13 permanent, require bonds for Type 11/13 filers, and push non-owner consignees (postal operators, forwarders, carriers) to use a licensed broker as importer of record. It is the rule that will govern low-value compliance once the suspended $800 de minimis exemption fully sunsets 1 Jul 2027. Comments on that proposed rule are still due 7 Dec 2026.

DOJ Fraud Division Directive 26-12

Issued 1 Oct 2026, the directive names tariff evasion, forced labor, and import-related fraud as one of four corporate-enforcement priorities for the Fraud Division, with ten aggravating factors — multi-year conduct, multi-district harm, $25M+ losses, and transfers to foreign adversaries among them — carrying “great weight” in charging decisions. Review your compliance program and self-disclosure posture against it this cycle.

BIS's 50% Affiliates Rule — enforcement begins 10 Nov 2026

After a year-long suspension (originally effective 30 Sep 2025, pushed to 10 Nov 2026), BIS's rule extending Entity List, Military End User, and SDN restrictions to any entity 50%-or-more owned by a listed party takes effect in two weeks. Ownership-chain screening — not just name screening — becomes a hard requirement; minority stakes under 50% remain a red flag, not an automatic bar.

OFAC's standalone Cuba Sanctions Regulations are now in force

Executive Order 14404 (1 May 2026) created the CSR, effective 30 Sep 2026 alongside amended CACR: U-turn transactions are eliminated, dealings with Cuba Restricted List entities are banned outright, and banks must block existing accounts for independent Cuban entrepreneurs absent a specific license. Update sanctions-program documentation to cite the CSR, not just the CACR.

EUDR due-diligence readiness

The Council's formal adoption of the revised EUDR — the last legislative step after Parliament's amendments — locks in a one-year delay with modest simplifications, not the postponement some importers hoped for: large operators still face the 30 Dec 2026 due-diligence and geolocation deadline for cattle, cocoa, coffee, oil palm, soya, rubber, and wood products; micro/small operators get to 30 Jun 2027. About nine weeks out for large operators, supplier-by-supplier statements need to be real.

EU Packaging & Packaging Waste Regulation — now in force

Regulation (EU) 2025/40 has applied directly across the EU since 12 Aug 2026: the declaration-of-conformity and PFAS restriction on food-contact packaging took effect that day, and Extended Producer Responsibility registration obligations followed. Design-for-recycling grading, minimum recycled-content rules, and single-use plastic bans phase in through 2030; harmonised labelling follows in 2028–2029. Confirm EU-bound packaging specs and supplier declarations already reflect it.

EU Product Identifiers & the new handling fee — one week to go

From 1 Nov 2026 — now one week out — B2C e-commerce imports into the EU need a standardized or non-standardized product identifier on the customs declaration, and the same date brings the EU-wide handling fee created by the Customs Reform Regulation (2026/2108). Confirm platform and carrier systems can capture both the identifier and the fee before the switch.

consilium.europa.eu

EU IOSS Right-to-Use (RTU) — prep window now open

From an expected January 2027 start, an IOSS number will only cover operators its holder has explicitly authorized — carriers, postal operators, brokers, and representatives each need a named authorization, revocable by the holder. An unauthorized filer loses IOSS treatment and import VAT is collected at the border as if no IOSS number existed. The Commission's implementing guidance on the mechanism is still pending; use the remaining weeks of Q4 to confirm your authorization lists with every party who files on your IOSS number.

UK CBAM: secondary legislation now in place

The Carbon Border Adjustment Mechanism (Emissions and Verification) Regulations 2026 (SI 2026/809) were laid in July, confirming a £50,000 minimum-liability threshold and quarterly sector rates for aluminium, cement, fertilizers, hydrogen, and iron & steel ahead of the 1 Jan 2027 start (glass and ceramics follow later).

South Korea's e-commerce customs platform & PCCC renewal

Korea Customs Service's e-commerce clearance platform went live 15 Aug 2026 after a registration window that closed 31 Jul; a further phase of mandatory platform-operator registration under the broader e-commerce customs clearance system continues to roll out. Separately, Personal Customs Clearance Codes issued from 2026 are now valid for one year and must be renewed through UNI-PASS; existing codes expire on the holder's birthday in 2027 and are auto-cancelled if not renewed within 30 days of that date, alongside OTP buyer-identity verification phasing in through Feb 2028.

UAE / Bahrain: 12-digit HS transition

Bahrain moved to 12-digit tariff codes back in January 2025. The UAE is mid-rollout — a phase covering mainland imports from the rest of the world runs through January 2027 — so classification masterfiles built on the old 8-digit structure need remapping on a rolling basis, not all at once.

Colombia's advance import declaration — already in force

Decree 659 (effective since June 2024) lets, and in practice increasingly requires, importers to file an advance import or advance entry declaration up to 48 hours before cargo arrival. It's not new this week, but it's an easy one to miss in onboarding checklists for new Colombia lanes — confirm it's built into your broker's filing workflow there.

Vietnam: de minimis cut and postal/customs overhaul in process

The Ministry of Finance has proposed cutting the duty-exemption threshold to $4 per shipment (from $40-or-$4-duty for post/express, $20-or-$2-duty for other imports), citing split-order and undervaluation concerns; it's a draft decree out for public comment with no effective date yet. In parallel, a draft Postal Law would move providers from prior approval to registration-based oversight (tentatively targeted for 1 Jul 2027), and 2026 customs-law amendments already strengthened IP recordal requirements. Track all three as one regulatory package.
